A Complete Guide On How To Transfer Vehicle Ownership

The process of buying and selling ‘used vehicles’ has simplified a lot over the years as there are many online platforms that allow the buyers and sellers to interact directly, however, there are some conventionalities that still remain the same such as the transfer of vehicle ownership on the registration certificate. As per the laws by the Government of India, it is mandatory to change the name of the owner on the RC when one sells the vehicle. RC transfer is a legal formality and a set of steps are supposed to be followed for transferring it from one person to another.

A very crucial step, transfer of vehicle ownership ensures that the vehicle legally belongs to the new buyer. In fact, all the legal liabilities are also transferred to the new buyer, once you sell a car and transfer the RC. Transfer of ownership is necessary as per the Indian law of Motor Vehicle Act, 1988. Not only does it imply shifting ownership to the new owner, but it also safeguards the vehicle, at the same time, helps to avoid any disputes in the future related to vehicle registration. Therefore, it is important to abide by this law for the smooth transfer of the vehicle to the new buyer.

In spite of being a key business in India, not many people are aware of the steps involved in vehicle resale, especially the transfer of ownership from the seller to the buyer. Are you wondering what should be done for the transfer of vehicle ownership? Well, all you need to do is fill an application form and carry some documents to the regional transport office (RTO). Though there are quite a few vehicle registrations offices in India, you need to visit your local RTO for the completion of the steps involved in transferring vehicle ownership.

Here are the documents you need to submit:

  • Present a request for transfer of vehicle ownership through Form 29 and 30.
  • Both the forms are to be submitted along with the passport size photographs.
  • Vehicle Registration Certificate.
  • No Objection Certificate (NOC) in case a vehicle was first registered in some other state.
  • Identity and Address proof.
  • Report of NCRB, if applicable.
  • Vehicle insurance certificate.
  • A photocopy of the Pollution under control (PUC) certificate.
  • Applicable Transfer fee.

Once these documents are submitted to the local RTO, the verification process will be done for the approval of the documents. Ideally, you must apply for RC transfer within 14 days of selling the vehicle. It takes about a week to transfer RC, however, this may vary from one RTO to another. To say it all, There are multiple RTOs present in the country but every state has at least one RTO and many DTOs.
